These terms of use are an agreement between you and Stéphane Darryl Wamo Nkengue, doing business as Yana ("we"), for the use of the Yana app. By using it, you accept them. If you do not accept them, do not use Yana.
Yana is a personal development app. You choose an area of life and a goal, answer a few questions, and the app builds a journey of 14 to 90 days. Each day it offers a morning audio session, with a mission, and an evening session, written and read by an artificial intelligence from what you share with it.
We may change, suspend or stop all or part of the service. If we stop it permanently, we will let you know in advance as far as possible.
You must be at least 16 years old to use Yana. If you have not reached the age of majority where you live, you confirm that you have the consent of a parent or guardian, in particular to buy a subscription.
You can use Yana without an account, with Apple or with Google. An account without sign-in exists only on your device: you can link it to Apple or Google from Profile so you don't lose it. You are responsible for access to your device and accounts.
You can delete your account at any time from Profile › Delete my account. This does not cancel your Apple subscription (section 4).
Your sessions, missions and plans are generated automatically by an artificial intelligence (OpenAI) from what you write. This content may be imperfect, inaccurate or not right for you: you remain free not to follow it, and the sole judge of what you do.
If you are in distress or in danger, contact emergency services or a helpline in your country immediately.
What you write belongs to you. You only grant us the right to use it, and to pass it to our providers, in order to provide the service, as described in our privacy policy. The content produced for you (texts and audio of your sessions) is for your personal use.
You agree not to write illegal or hateful content or content that infringes the rights of others, and not to use Yana to target another person.
Some features require an auto-renewing subscription, monthly or yearly, bought through the App Store and charged to your Apple ID.
To keep the service reliable, the subscription includes two sessions a day (one morning, one evening) and a monthly safety limit; it is not "unlimited". Prices may change; Apple informs you before a new price applies.
The Yana app, its design, code, texts, voices, soundscapes and brand belong to us or our licensors. You receive a personal, non-exclusive, non-transferable licence to use the app, under Apple's standard licence agreement (EULA), which these terms supplement.
Yana relies on providers: OpenAI (writing sessions, and voice in English), ElevenLabs (voice of French sessions), Supabase (hosting), RevenueCat and Apple (subscriptions), Apple and Google (sign-in). How they are used is described in our privacy policy.
You can stop using Yana and delete your account at any time. We may suspend or close an account that breaches these terms, letting you know when possible.
The service is provided "as is". To the fullest extent permitted by law, we are not liable for indirect damages resulting from your use of Yana, nor for decisions you make based on its content. Nothing in these terms limits the rights you have under the consumer protection law of the place where you live.
These terms are governed by the laws of Quebec and the applicable federal laws of Canada. Any dispute falls under the courts of Quebec, subject to the mandatory rights you have where you live.
We may change these terms; the date at the top shows the latest version. For significant changes, we will let you know in the app. Continuing to use Yana after a change means you accept the new terms.
